Monarch Networth Asset Management Private Limited
1. Application
These terms and conditions (“Terms”) apply to the use of the monarchamc.in website, the web applications and other applications of Monarch Networth Asset Management Private Limited (“Monarch AMC” or the “AMC”), and the related social media pages and profiles of the AMC and of Monarch Mutual Fund (the “Mutual Fund”) (collectively, the “Sites”).
2. Acceptance
By accessing or using the Sites, the user confirms that they have read and understood these Terms and agrees to be bound by them. Any user accessing the social media pages or profiles of the Mutual Fund or the AMC sites, or tagging the AMC, shall be deemed to have accepted and agreed to be bound by these Terms and by the terms of use of the sites and underlying social media platform. If the user does not intend to be legally bound by these Terms, the user should refrain from using the Sites.
3. Documents to be read together
These Terms shall be read in conjunction with the Privacy Policy and the Disclaimer published on the Sites, and with the Scheme Information Document, the Key Information Memorandum and the Statement of Additional Information of the relevant scheme (collectively, the “Scheme Related Documents”). Terms not specifically defined in these Terms shall be read and understood as defined in the Scheme Related Documents, as amended from time to time.
4. Electronic authentication
The authentication of electronic records through verification of the PAN or User ID allotted by the AMC or created by the user, or through any other mode of verification as may be stipulated from time to time at the discretion of the AMC, which are recognised under the Information Technology (Amendment) Act, 2008 for authentication of electronic records, shall be valid as equivalent to physically signed records submitted by the unitholder or user.
5. Credentials
The user is solely responsible for maintaining the secrecy and confidentiality of the folio number, PAN, User ID and password, without any liability of the AMC in this regard. Protection of the password shall be the sole responsibility of the authorised user. Access to and use of password-protected or secure areas of the Sites is restricted to authorised users only, and users must not obtain, or attempt to obtain, unauthorised access to such areas.
6. Instructions
All instructions shall be given by the user in the manner indicated by the AMC. Any instruction, order, direction or request entered using the PAN or User ID of the user shall be deemed to be an instruction received from the user. The user is responsible for the accuracy and authenticity of the instructions provided, and the AMC shall not be required to independently verify them. Entering an instruction does not guarantee its execution. The AMC may decline to act on any instruction where it has reason to believe that the instruction is not genuine, is unclear, raises a doubt, or is otherwise improper and cannot be put into effect.
7. Accuracy of information
The user is responsible for the correctness of the information supplied to the AMC. The AMC accepts no liability for the consequences arising out of erroneous information supplied by the user. If the user notices an error in the information supplied, the user shall immediately advise the AMC, which will endeavour to correct the error wherever possible on a reasonable efforts basis.
8. Time stamping and applicable Net Asset Value
Any request for a transaction on the Sites shall be time stamped consistent with the terms of the Scheme Related Documents. The Net Asset Value applicable for purchase, redemption or switch shall be based on the time of the business day on which the application is received, and shall be subject to the provisions relating to realisation of funds and cut-off timings as described in the Scheme Related Documents and SEBI Mutual Fund Regulations. Any transaction entered after the cut-off time shall be deemed to be received on the succeeding business day and shall be processed accordingly.
9. Bank account details
If an incorrect bank account number is provided by the user, the redemption proceeds could be credited to the wrong bank account so provided, and there is no guarantee of recovery of the same. The AMC and the Mutual Fund shall not be held liable for any loss or damage that may be sustained by the user on account of such error on the part of the user.
10. Availability of the Sites
The AMC may, in its sole discretion and at any time, discontinue, temporarily or permanently, any or all of the facilities offered on the Sites, without notice. The AMC does not charge any service fee towards the facilities provided on the Sites, and such facilities are liable to be withdrawn at the absolute discretion of the AMC.
11. Distributors
Access to and use of the Sites by a distributor shall be governed by these Terms together with the empanelment agreement, distribution agreement and service level agreement entered into by the distributor with the AMC, the terms, conditions and disclaimers available on the Sites, and the Scheme Related Documents.
12. Modification
The AMC reserves the right to modify these Terms at any time. Continued use of the Sites, and availing of the facilities provided therein, subsequent to any modification shall be construed as the user having read, understood and agreed to be bound by the revised Terms.
13. Governing law and jurisdiction
These Terms shall be governed by the laws of India. Any legal action or proceeding arising out of these Terms shall be brought in the courts or tribunals at Mumbai, India, and the user submits to the jurisdiction of such courts and tribunals.
