1. Acceptance
This website (“Site”) is maintained by Monarch Networth Asset Management Private Limited (“AMC”), investment manager to Monarch Mutual Fund (“Mutual Fund”), for the personal information of users. Please read this page carefully: by accessing or using the Site, the user confirms that they have understood these terms of usage, agrees to be bound by them, and accepts the exclusions and limitations of liability stated below as reasonable. If any provision of these terms is found unenforceable under applicable law, the remaining provisions shall continue in full force.
2. Nature of information
The Site displays information relating to the schemes of the Mutual Fund, investor education material and general information, and is provided for information purposes only. Such information is subject to change from time to time without notice. Nothing on the Site should be construed as an offer to sell, a solicitation of an offer to buy, or a recommendation for, any scheme or product of the AMC or the Mutual Fund.
3. Offer only through scheme documents
Units of the schemes of the Mutual Fund are offered only through the Scheme Information Document read with the Statement of Additional Information, or the Key Information Memorandum, of the relevant scheme, prepared in accordance with the SEBI (Mutual Funds) Regulations, 1996, as amended from time to time. The Scheme Information Document contains the information necessary for an investor to make an informed investment decision. Users are requested to read the Scheme Information Document and Statement of Additional Information in their entirety before making any investment decision, to retain them for future reference, and to consult their own independent professional and tax advisors before investing.
4. Jurisdiction of access
The information on the Site does not constitute an offer or solicitation to any person in any jurisdiction where such an offer or solicitation would be unlawful. It is the sole responsibility of the user to verify that their use of the Site, and any investment or service availed, conforms with the laws applicable in their jurisdiction. Units of the schemes are not registered in any jurisdiction other than India.
5. Third-party content and linked sites
The Site may display reports, data or information provided by third parties, and may contain links to other websites for the convenience of users. The AMC makes no representation about, and accepts no responsibility for, the content, accuracy, availability or privacy practices of any third-party content or website. Users are advised to read the terms and disclaimers of any such website and to confirm the accuracy of any information before relying on it. The AMC disclaims all liability that a user may incur as a result of relying on such information or accessing any other website through the Site.
6. Accuracy and availability
While the Site may be updated periodically and the AMC will make sincere efforts to keep it current, the AMC does not guarantee that the Site reflects the latest information at all times, nor the correctness, accuracy or reliability of any data, nor uninterrupted or error-free availability of the Site. Despite the security measures taken, no website is entirely free from the risk of hacking or other interference, and the AMC disclaims liability for any loss or damage arising from any alteration or manipulation of data accessed or downloaded from the Site, or from the transmission of any virus or other harmful code.
7. Limitation of liability
The AMC, the Trustee, their directors, employees and agents shall not be responsible for any liability towards any person or entity directly or indirectly suffering any consequential loss, damage or claim of whatsoever nature, whether in contract, tort or otherwise, as a result of any shortcoming, defect or inaccuracy that may have inadvertently crept into the Site, or otherwise from the use of information available on the Site in any manner.
8. Intellectual property and permitted use
Copyright, trademark and other intellectual property rights in the Site and its contents are owned by the AMC, its licensors or the relevant third-party content providers. Users may download material displayed on the Site for personal, non-commercial use only, and may not distribute, modify, transmit, reuse, reproduce, publish or commercially exploit the contents of the Site — including text, images, audio and video — without the prior written permission of the AMC, nor delete, modify or otherwise interfere with any copyright or other proprietary notice displayed on the Site.
9. Password-protected areas
Access to and use of password-protected or secure areas of the Site is restricted to authorised users only. Users must not obtain, or attempt to obtain, unauthorised access to such areas. Protection of the password shall be the sole responsibility of the authorised user.
10. Services and their terms
Before availing any service or facility offered through the Site, users are requested to separately accept the terms and conditions applicable to that service or facility and agree to be bound by them. The AMC may at any time amend or discontinue any service or facility offered on the Site, or these terms of usage.
11. Performance and returns
Past performance of the schemes may or may not be sustained in the future and is not indicative of future results. The AMC and the Mutual Fund do not guarantee, offer or communicate any indicative yields or assured returns on investments made in the schemes of the Mutual Fund.
13. Compliance with laws, governing law and jurisdiction
The user undertakes to comply with, and be bound by, all applicable laws and statutory requirements in India. These terms of usage shall be governed by the laws of India. Any legal action or proceeding arising out of the use of the Site, or of any service offered through it, shall be brought in the courts or tribunals at Mumbai, India, and the user submits to the jurisdiction of such courts and tribunals.
12. Social media
The Mutual Fund and the AMC maintain pages and profiles on social media platforms. Use of, posting on, or tagging such pages is subject to these terms and to the terms of use of the relevant platform. Content on such pages is for information only and does not constitute an advertisement, endorsement, advice, or an offer or solicitation for any scheme. The AMC will never solicit personal information such as PAN or bank account details through social media, and users should not post or send sensitive personal, confidential or financial information on such platforms, nor use them to request transactions or lodge complaints — these should be routed to the AMC’s investor service contact points published on the Site. The AMC reserves the right to delete content on its social media pages that it considers unlawful, abusive, offensive or inappropriate.
